SEC sends Wells Notice to SolarWinds recommending civil enforcement action relating to 2020 solar Winds cyberattack

An SEC filing by SolarWinds says that the enforcement staff of the SEC has sent the company a “Wells Notice” concerning the company investigation of the cyberattack by Russian State actors in 2020. The notices state that the SEC staff has made a preliminary determination to recommend that the SEC file a civil enforcement action against the recipients alleging violations of certain securities laws.

Solar Winds began notifying its customers of the breach in mid-December 2020. The company denies wrongdoing.
