Federal prosecutors in Vermont are prosecuting a False Claims Act case against another electronic health records company, Modernizing Medicine, Inc. Recently unsealed documents, including the complaint, reveal that a former executive of Modernizing Medicine filed a whistleblower lawsuit against the company and its co-founders. The complaint alleges that ModMeds’ patient records software did not work as promised and cheated the federal certification tests and created incentives for doctors in ways that violated anti-kickback laws. The complaint also says that some errors were integrated into the software so ModMed could make more money. ModMeds software used incorrect billing codes that yielded higher fees, according to the complaint. The whistleblower is former ModMed Vice President of product management Amanda Long.
